Terms of Service

These Terms govern your access to and use of Vesperdesk, the AI receptionist service operated by Vesperdesk GmbH, Frankfurt am Main, Germany. By signing the pilot agreement or otherwise using the service, you agree to be bound by these Terms.

1. Service

Vesperdesk reads your real estate listings (properties, PDFs, internal rules) and produces grounded answers across the chat channels you nominate. During the private pilot we work with each agency one at a time; the service is not generally available.

2. Acceptable use

You agree not to use Vesperdesk to discriminate against protected groups, to sidestep Fair Housing obligations, or to make legally binding statements about properties you do not control. We may suspend access if usage breaches these principles.

3. Data ownership

Your listings, conversations and settings remain yours. We only use them to run the service for you. We do not sell data, and we do not use your data to train third-party foundation models.

4. Availability

During the pilot, Vesperdesk runs on a best-effort basis without a guaranteed uptime SLA. Specific SLAs will be set out in your individual pilot agreement.

5. Liability

Vesperdesk is a conversation tool. It is not a replacement for licensed real estate advice, legal counsel or a human review of binding decisions. Our total liability during the pilot is capped at the fees paid for the relevant period.

6. Changes

We may update these Terms during the pilot. Material changes will be communicated to the contact named on your pilot agreement at least fourteen days in advance.

7. Governing law

Governing law and jurisdiction will be confirmed once the business is formally incorporated. During the pilot, any disputes will be resolved in good faith directly between the parties.
